Definitions and Agreement to Terms
“Mynians VoIP,” “we,” “us,” or “our” refers to Mynians, LLC, a Florida-registered business communications provider operating as Mynians VoIP, with principal operations in Orlando, Florida. “Client,” “you,” or “your” refers to the business entity or individual that has completed a Service Order Form and activated VoIP phone services through Mynians VoIP.
By submitting a Service Order Form, activating service, making payment, or using any Mynians VoIP platform feature, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in their entirety. These Terms constitute a legally binding agreement between you and Mynians VoIP. If you accept these Terms on behalf of a business entity, you represent that you have the authority to bind that entity.
We reserve the right to update these Terms at any time. Material changes will be communicated via email to your account’s registered address at least 30 days in advance. Continued use of our services following that notice constitutes your acceptance of the revised Terms. The current version is always available at voip.mynians.com/terms-and-conditions.
These Terms should be read alongside our Privacy Policy and any applicable Statements of Work or Service Order Forms, all of which are incorporated herein by reference.
Service Activation and Eligibility
Mynians VoIP services are available to business entities and sole proprietors operating within Florida and select surrounding markets. Residential-use customers are not eligible for standard business plans. We reserve the right to verify business eligibility prior to activation.
Service activation requires the following:
- Completion of a signed Service Order Form with minimum line quantities confirmed (5 lines for Essential and Professional plans; 10 lines for Enterprise)
- Verified broadband internet connection meeting minimum bandwidth per FCC broadband guidelines — 1 Mbps per concurrent call
- Payment of applicable setup fees and first month’s service charges at time of order
- Signed acknowledgment of the 911 Emergency Service Limitations Notice (Section 4)
We target a 72-hour installation window across Orlando, Tampa, Miami, and Jacksonville. Actual timelines may vary based on number porting requirements, equipment shipping, and site readiness. Our installation team provides a pre-activation site assessment at no additional charge for qualified accounts.
Billing and Payment Terms
Services are billed monthly. Invoices are generated on the first business day of each calendar month and are due within 15 days. Current rates per line, per month:
- Essential Plan — $17.95/line (minimum 5 lines)
- Professional Plan — $27.95/line (minimum 5 lines) — most popular
- Enterprise Plan — $32.99/line (minimum 10 lines) — includes HIPAA BAA
All prices are in U.S. dollars and exclude applicable state and local taxes, regulatory fees, and surcharges mandated by Florida law or federal telecommunications regulations. These pass-through charges are itemized on each invoice. Mynians VoIP does not mark up regulatory fees beyond their actual cost.
Accounts unpaid after 30 days from the invoice due date may incur a late fee of 1.5% per month on the outstanding balance, or the maximum permitted by Florida Statute §687.02, whichever is less. Service may be suspended at 45 days past due. A $25 reconnection fee may apply. Payment disputes must be submitted in writing to info@voip.mynians.com within 30 days of the invoice date. Price adjustments require 30 days written notice; you may terminate without penalty if you object to a pricing change within that notice period.
We accept ACH bank transfer (no processing fee), major credit cards (2.9% processing fee), and corporate checks.
911 Emergency Service — Required Disclosure
⚠️ Required FCC Disclosure — Please Read Before Activation
VoIP-based 911 service operates differently from traditional landline 911. The FCC requires this disclosure to all subscribers before service activation. You must acknowledge this notice as part of your Service Order.
Mynians VoIP provides E911 (Enhanced 911) service that transmits your registered address to the local Public Safety Answering Point (PSAP). However, VoIP 911 is subject to these limitations, which do not apply to traditional landline emergency service:
- 911 may not function during a power outage or if your internet connection is disrupted at your premises
- If you move VoIP equipment to a different address without updating your registered location in your account portal, emergency responders may be dispatched to the wrong location
- In the event of complete internet outage, 911 calls cannot complete through VoIP — always keep a backup mobile phone available for emergencies
- Certain rural Florida county PSAPs may not yet support VoIP E911 routing — calls may be routed to a national emergency relay operator in those cases
You are required to maintain your registered service address in your account portal at all times. Mynians VoIP is not liable for 911 failure resulting from incorrect address information, internet outages outside our network, or equipment failure at your premises. You agree to inform all employees and users of your phone system of these limitations, as required by FCC VoIP E911 requirements.
Enterprise clients with our failover configurations can maintain 911 connectivity during internet outages via cellular backup. See our redundancy and failover guide for details. We strongly recommend this configuration for healthcare, legal, and financial services clients.
Acceptable Use Policy
Mynians VoIP services are for lawful business communications only. The following are strictly prohibited and may result in immediate service suspension without refund:
- Unsolicited commercial messaging (spam) or robocalling in violation of the TCPA or Florida Telephone Solicitation Act
- Fraudulent, deceptive, or misleading communications of any kind
- Harassment, threats, or abusive communications toward any person
- Unauthorized access to or interference with any telecommunications network or system
- Use of services to facilitate any activity that violates local, state, federal, or international law
- Resale or sublicensing of Mynians VoIP services to third parties without prior written authorization
- Artificially inflating call volumes or usage metrics to exploit flat-rate calling plans
Clients using outbound sales or customer contact capabilities are responsible for their own TCPA compliance, Do-Not-Call registry scrubbing, and call recording disclosures as required by Florida Statute §934.03 and the FTC Do-Not-Call Registry. Call recording capabilities are provided as a technical feature only; compliance responsibility rests with the client. Violations result in 48 hours written notice to cure, except in cases of severe or illegal abuse where immediate suspension is warranted.
Number Porting
Mynians VoIP supports porting of existing business phone numbers from your current carrier, per FCC Local Number Portability (LNP) rules. Porting typically takes 3–10 business days depending on your current carrier. We provide a Letter of Authorization (LOA) and guide you through submission at no additional charge.
During the porting process, your existing service remains active until the port is confirmed complete. You are responsible for maintaining and paying your current carrier service until that date. Mynians VoIP is not responsible for delays caused by your current carrier, incomplete LOA submissions, or account information discrepancies.
You have the right to port your number away from Mynians VoIP at any time, provided your account is in good standing. We will not block or delay number porting requests. See our number porting guide for the full process. The FCC provides additional consumer porting protections that apply to your account.
Service Availability and SLA
Mynians VoIP guarantees 99.99% network uptime measured monthly from our core infrastructure. Our dual Florida data centers — located in Jacksonville and Tampa — deliver an average 12ms latency across the state. Scheduled maintenance windows (typically 2:00–5:00 AM EST) are excluded from uptime calculations and communicated at least 72 hours in advance.
If network uptime falls below 99.99% in any calendar month due to causes within our control, affected clients are eligible for the following service credits:
- 99.0% – 99.98% uptime: 10% credit on that month’s invoice
- 95.0% – 98.99% uptime: 25% credit on that month’s invoice
- Below 95.0% uptime: 50% credit on that month’s invoice
Service credits are the sole and exclusive remedy for service interruptions and must be requested in writing within 30 days of the interruption. Credits do not apply to outages caused by client-side internet failures, third-party carrier issues, force majeure events including Florida hurricanes, or client-initiated changes. Our average support response time is 8 minutes, with 24/7 emergency support at (407) 374-2782.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYNIANS VOIP’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO MYNIANS VOIP DURING THE THREE (3) CALENDAR MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Mynians VoIP is not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost business opportunities, data loss, or reputational harm — even if we have been advised of the possibility of such damages. This applies to the fullest extent permitted under Florida law and does not affect your statutory consumer rights.
We are not liable for service interruptions caused by factors outside our reasonable control, including acts of God, natural disasters (including Florida hurricanes), third-party ISP outages, cyberattacks, or power grid failures. Our hurricane-tested infrastructure minimizes disruption — see our business continuity planning — but no system can guarantee 100% availability under all conditions. The U.S. Small Business Administration recommends maintaining independent business interruption insurance.
Termination
Either party may terminate service with 30 days written notice to the other party’s registered contact address. Client cancellation requests must be submitted in writing to info@voip.mynians.com or via certified mail to our Orlando, Florida office. Verbal cancellation requests are not accepted.
Mynians VoIP may terminate service immediately without prior notice in cases of: material breach of the Acceptable Use Policy; non-payment exceeding 60 days; fraudulent activity; or actions that threaten the security or integrity of our network or other clients’ service. Any outstanding balance becomes immediately due and payable upon such termination.
Upon termination, you retain the right to port your phone numbers to another carrier within 90 days, provided your account is in good standing. We will provide all required porting authorizations within 2 business days of a valid request. Your call recordings and voicemail data will be purged within 60 days of account closure unless retention is required by applicable law.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law provisions. Disputes shall first be addressed through 30 days of good-faith negotiation. Unresolved disputes will be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Orange County, Florida.
Either party may seek injunctive or equitable relief in a court of competent jurisdiction in Orange County, Florida, without waiving the right to arbitrate all other claims. The prevailing party in any arbitration or court proceeding is entitled to recover reasonable attorneys’ fees and costs.
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and remaining provisions continue in full effect. These Terms, together with your Service Order Form, constitute the entire agreement between you and Mynians VoIP. For questions, contact us at info@voip.mynians.com or (407) 374-2782.
Why 500+ Florida Businesses Trust Mynians VoIP
Switching from AT&T Business to Mynians was the best telecom decision we’ve made in years. The terms are simple, billing is transparent, and our monthly bill dropped by $520. No surprises after 14 months.
As a healthcare practice, HIPAA compliance in our phone system is non-negotiable. Mynians was the only Florida VoIP provider that offered a proper Business Associate Agreement with clear, readable terms. No other provider came close.
We have five locations across Miami-Dade and Orange County. Mynians ported 47 numbers seamlessly and the month-to-month terms mean we’re never locked in. No national provider offered this flexibility at this price point.
Terms & Conditions FAQ
Here are the most common questions Florida business owners ask about our service agreement before signing up.
No. Our standard service plans are month-to-month with no annual contract. Cancel with 30 days written notice at any time without paying an early termination fee. This is a core differentiator from national providers like AT&T Business and Comcast, which typically require 2–3 year commitments. Enterprise and custom multi-location agreements may offer optional term pricing with additional discounts, but these are never mandatory.
Your phone numbers remain yours. Under FCC Local Number Portability rules, you can port your numbers to any carrier at any time, including after cancellation. We provide all required porting authorizations within 2 business days of a valid request, provided your account is in good standing. Numbers can be ported out up to 90 days after account closure. Our number porting guide explains the full process.
Yes. HIPAA Business Associate Agreements (BAA) are included with our Enterprise plan at $32.99/line/month (10-line minimum). The BAA covers call handling, voicemail storage, call recording, and data transmission per HHS HIPAA Security Rule requirements. If you operate a medical practice, dental office, mental health clinic, or any HIPAA-covered entity, visit our HIPAA-compliant VoIP Florida page for full details.
Billing disputes must be submitted in writing to info@voip.mynians.com within 30 days of the invoice date. Include your account number, invoice date, the specific charge in question, and a brief explanation. Our billing team responds within 2 business days. You can also call (407) 374-2782 to discuss a billing question before submitting a formal dispute.
Our infrastructure operates dual data centers in Jacksonville and Tampa with automatic failover routing. During a hurricane or power event, Enterprise plan clients with cellular failover can maintain 911 and business call capability even if their local internet goes down. Every Florida business should review our failover and redundancy guide and our installation process to understand their resilience options. The FCC provides additional guidance on 911 during emergencies.
